1. Acceptance of Terms:

By accessing and using EazySites.com (the "Site") and our website Content Management System (the "CMS"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use our services.

2. Description of Service:

EazySites.com provides a platform for users to create and manage websites using our CMS. We offer various monthly and annual subscription plans with different features, which may be subject to change or updates at our discretion.

3. User Accounts:

  • You must provide accurate and complete information when registering for an account.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You are responsible for all activities that occur under your account.

  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content:

  • You retain ownership of the content you create and upload to your websites ("User Content").

  • You grant EazySites.com a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your User Content for the purpose of providing our services.

  • You are responsible for ensuring your User Content complies with applicable laws and regulations.

  • You must not upload or distribute content that is illegal, harmful, or infringes on the rights of others. This includes, but is not limited to:

    • Content that is unlawful, defamatory, harassing, abusive, fraudulent, or deceptive.

    • Content that promotes or facilitates illegal activities, scams, or hate speech.

    • Content that infringes on any intellectual property rights, including copyrights and trademarks.

    • Content that is obscene, pornographic, or otherwise objectionable.

    • Content that could damage the reputation of EazySites.com.

    • Malware, viruses, or other harmful code.

  • EazySites.com has the right to remove any content that violates these terms.

5. Payment and Subscription:

  • We offer monthly and annual subscription plans.

  • You agree to pay the fees associated with your chosen plan.

  • Subscription fees are billed in advance and are non-refundable. Users benefit from full feature access during any trial period, therefore refunds are not available.

  • You can cancel your subscription at any time through your account settings. Cancellation will result in continued access to the paid features until the end of your current billing period.

  • All subscriptions automatically renew at the end of each billing period. You can cancel auto-renewal at any time through your account settings.

  • If a payment cannot be processed (e.g., expired card, insufficient funds), we will provide a 30-day grace period for you to update your payment information.

  • After the 30-day grace period, if payment is not received, access to paid features will be suspended. This may result in your public website becoming inaccessible via your custom domain name.

  • EazySites.com reserves the right to change our pricing and subscription plans at any time. We will provide reasonable notice of any changes.

6. Intellectual Property:

  • EazySites.com owns all intellectual property rights in the Site and CMS, including software, design, and trademarks.

  • You may not reproduce, modify, or distribute our intellectual property without our express written consent.

  • Any feedback or suggestions you provide to us may be used by us without any obligation to you.

7. Third-Party Services:

  • Our CMS may integrate with third-party services, such as Google Analytics, HubSpot, and other plugins or applications.

  • Your use of third-party services is subject to their respective terms and privacy policies.

  • We are not responsible for the actions or omissions of third-party service providers.

8. Acceptable Use:

  • You agree to use our services in a lawful and responsible manner.

  • You must not use our services to engage in any illegal or harmful activities.

  • You must not attempt to disrupt or interfere with the operation of our Site or CMS.

  • You must not use our services to send spam or unsolicited communications.

  • You are responsible for the security of your website and data.

9. Disclaimer of Warranties:

  • Our services are provided "as is" and "as available" without warranties of any kind, express or implied.

  • We do not warrant that our services will be uninterrupted, error-free, or secure.

  • We disclaim all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability:

  • EazySites.com shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services.

  • Our liability shall be limited to the amount you paid for our services in the preceding 12 months.

  • You agree to indemnify and hold EazySites.com harmless from any claims, damages, or expenses arising from your use of our services or your violation of these Terms.

12. Termination:

  • We may terminate your account and access to our services at any time for any reason, including but not limited to, violation of these Terms.

  • You may terminate your account at any time by following the instructions on our Site.

  • Upon termination, you will lose access to your User Content. You are responsible for backing up your data.

13. Changes to Terms:

  • We reserve the right to modify these Terms at any time.

  • We will provide reasonable notice of any changes by posting the updated Terms on our Site.

  • Your continued use of our services after the changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law:

  • These Terms shall be governed by and construed in accordance with the laws of Western Australia.

15. Dispute Resolution:

  • Any disputes arising from these Terms shall be resolved through the courts of Western Australia.

16. Data Backup and User Responsibility:

  • EazySites.com performs regular backups of its systems to ensure service continuity. However, you are ultimately responsible for backing up your own User Content. We recommend that you regularly export and save copies of your website data.

  • As with a shared responsibility model (similar to AWS), EazySites.com is responsible for the security and integrity of the platform itself, while you are responsible for the security and content of the websites you create using our CMS. This includes, but is not limited to, password management, plugin security, and content compliance.
